Two things: Have you updated your sources.list recently as recommended by Kano? You have to get a new sources list before you can do a dist-upgrade safely.
Are you running another package manager simultaneously with apt-get?

I havent updated the source list , how do you do that?
I also have Kpackage that I can update, but dont seem to be able to at this point either (are they cancelling each other out?) if so, how do I get rid of the Kpackage?

Maybe kpackage is running.
Close it, or restart, then follow the instructions in http://kanotix.com/files/fix/update-rc4.txt
